Women accuse New Orleans attorney of legal malpractice

NEW ORLEANS – Two Jefferson Parish women are suing their former attorney for alleged legal malpractice.

Angela Parker and Vicki Daigrepont filed suit against David A. Capasso and the Law Office of Capasso and Associates in Orleans Parish Civil District Court.

The plaintiffs were originally represented by the defendant in Vicky Daigrepont et al vs. Churchill Downs Corporation, a suit against their former employer.

The women claim that the defendant failed to timely oppose a motion to dismiss, failed to timely respond to requests for written discovery, failed to file witness and exhibit lists as the court’s scheduling required and failed to aid defense counsel in preparing a pretrial order. The plaintiffs further claim that Capasso failed to oppose five motions for summary judgment and instead filed a request to continue a hearing on the two motions after being granted an extension of time in which to oppose the motions. Furthermore, the defendant allegedly failed to request a second extension of time from the court before missing the deadline.

In a memorandum dated March 23, the defendant acknowledges “callous mistakes and errors” and admits that he “could have been held in contempt," the suit claims.

An unspecified amount of damages is sought for emotional distress. The plaintiffs are also requesting all the damages they  could have received in the underlying case.

The plaintiffs are represented by Jacques F. Bezou and Jacques F Bezou Jr. of Covington.

The case has been assigned to Division M Judge Paulette R. Irons.
