Valet sues garage gate manufacturer after accident

NEW ORLEANS – A local man is suing after being knocked unconscious by the garage gate at the hotel where he worked.

Jose Perez filed suit against RCN Inc. and Rytec Corporation in the Orleans Parish Civil District Court. The plaintiff was employed as a valet at the Hyatt Regency New Orleans in November 2011 when the accident occurred. Perez claims that he was entering the garage to retrieve a guest’s car when the metal gate suddenly fell, striking him on the head. He was rendered unconscious and the gate continued descending before bouncing back and causing multiple lacerations to Perez’s face and head.

The defendant is accused of failing to warn the plaintiff that the gate could suddenly descend while people were under it.

Damages not in excess of $75,000 are sought as compensation for the plaintiffs injuries including loss of consciousness, internal head trauma, scarring and lacerations to his head and face requiring stitches.

Perez is represented by Timothy D. Scandurro and Dewey M. Scandurro of Scandurro & Layrisson LLC.

The case has been assigned to Division F Judge Christopher J. Bruno.
