Wrongful death suit brought against three Orleans Parish corporations

NEW ORLEANS – The son of a deceased independent contractor is suing a total of four local corporations and their insurers on claims of wrongful death and damages.

Michael Jermain Polk filed a lawsuit against Blackrock Aggregates LLC, Baker Transportation & Logistics LLC, Baker Ready Mix LLC, BAC #2 Investments LLC, Travelers Insurance Co. and Seneca Insurance Co. in the Orleans Parish Central District Court on Jan. 11.

The plaintiff avers that the defendants, owners of an allegedly unsound concrete wall in the decedent’s work area on an Elysian Fields property, are responsible for his father, Dan Gordon’s death. According to the suit, the wall owned by defendants suddenly collapsed on Gordon causing him to sustain fatal injuries which consequently led to his death.

The defendant is accused of failing to maintain proper control of their property, failing to exercise reasonable care and failing to warn the decedent of the dangerous condition on their property.

An unspecified amount is sought for the pre-death pain and suffering suffered by decedent, mental anguish, medical expenses, funeral costs, emotional distress, loss of estate, loss of community and support and all other damages which may be shown at the trial of this matter.

The plaintiff is represented by Christopher R. Schwartz of the Metairie-based Schwartz Law Firm.

This case has been assigned to Division G Judge Robin M. Giarrusso.
