Ochsner Clinic accused of malpractice for dropping patient being treated for obesity-related issues

NEW ORLEANS - A Jefferson Parish woman being treated for obesity related health issues is suing Ochsner in a medical malpractice suit after allegedly being dropped by employees in the process of being transferred from her wheelchair to a patient bed.

Mildred Y. Jones filed a lawsuit against Ochsner Clinic Foundation in the Orleans Parish Central District Court on Feb. 4.


Jones claims that while being transferred from her wheelchair to the bed the defendant’s staff dropped her causing her left leg to land beneath her body and fracture her left fibula.


The defendant is accused of failure to exercise the requisite amount of care toward a patient that the particular patient’s condition may require, failure to protect the patient from dangers, failure to exercise proper transfer techniques in light of the petitioner’s physical limitations and failing to provide adequate staff on hand to assist petitioner.


The suit does not specify the amount sought for special and general damages, mental anguish, emotional pain and suffering, physical scarring and medical expenses.


Plaintiffs are represented by attorney Thomas D. Bates of New Orleans.


This case has been assigned to Division D Judge Lloyd J. Medley.
