NEW ORLEANS - A local licensed pest control company is being sued on the grounds that it failed to meet their contractual obligations.
3501 St. Claude Limited Partnership filed a lawsuit against Imperial Exterminating Company Inc. in the Orleans Parish Central District Court on Feb. 7.
The plaintiff claims that after entering into a contract with the defendants for the treatment of subterranean termites, four years into their renewable contract and warranty, the plaintiff discovered substantial termite damage within the confines of their property. Under contract Imperial was to be held responsible for the cost of necessary repairs associated with termite damage. The defendant has allegedly failed to reimburse the plaintiff for the cost of repairs.
Imperial is accused of breach of contract and violating the Louisiana Unfair Trade Practices and Consumer Protection Law.
The plaintiff is seeking reimbursement for cost of repairs plus all legal costs and attorney's fees.
Counsel for the plaintiff is Gina M. Palermo of New Orleans-based Stanley, Reuter, Ross, Thorton & Alford LLC.
This case has been assigned to Division C Judge Sidney H. Cates IV.
