NEW ORLEANS - After falling down stairs and being knocked unconscious for 30 minutes, a seaman has filed a lawsuit against his employer for failing to provide adequate lighting and non-skid materials on the stairs.
Danny Pat Emmons filed suit against Subsea 7 (US), SapuraAcergy SDN BHD, SapuraAcergy Assets PET Ltd., SapuraKencana Petroleum Berhad, Subsea & S.A., and Subsea 7 Malaysia SDN BHD, in personam, and the Sapura 3000 in rem on April 3 in federal court in New Orleans.
Emmons was allegedly injured on April 3, 2012 when he fell down a flight of stairs on board the Sapura 3000.
The defendants are accused of negligence for failing to provide the plaintiff with a safe place, and for failing to take reasonable precautions to provide adequate lighting and non-skid material on the stairs on board the Sapura 3000.
The plaintiff is seeking an award of damages for medical expenses, lost earnings, loss of earning capacity, physical injury, disability and scarring, physical pain and suffering, mental anguish and distress, loss of enjoyment of life, punitive damages, interest, court costs, and attorney’s fees.
Emmons is represented by Raul Bencomo of Bencomo & Associates in New Orleans.
U.S. District Judge Nannette Jolivette Brown is assigned to the case.
