Woman sues Chase Bank after tripping and falling

NEW ORLEANS – A New Orleans woman is suing Chase Bank after falling in front of one of its local banks.

Glenda Benoit filed suit against JP Morgan Chase & Company and their insurer in the Orleans Parish Civil District Court on March 5.

The alleged incident occurred on March 6, 2012 at the bank's Chef Menteur Highway location. Benoit claims she tripped on a bolt that was sticking out of the pavement while trying to use an ATM. The suit claims that both the bolt and the pavement surrounding it were painted white, making the bolt blend in.

The plaintiff sustained injuries to her shoulder and foot.

The defendant is accused of negligence for allowing an unreasonably dangerous condition of exist on its premises.

An unspecified amount of damages is sought for mental anguish, emotional distress, past, pain and suffering, loss of enjoyment of life and physical disability.

The case has been assigned to Division I Judge Piper D. Griffin.
