NEW ORLEANS – A New Orleans woman is suing a local retailer claiming she was injured by one of the store's shopping carts upon her exit.
Angele Myers filed a lawsuit against Dollar Tree Stores Inc. and Dollar Tree Store in the Orleans Parish Central District Court on March 13.
Myers claims that while pushing a shopping cart owned by defendants the wheels locked causing the cart to jerk back suddenly and striking her on her right shin.
The defendant is accused of failing to maintain shopping carts under their ownership in a safe condition, failing to properly repair a hazardous condition, failing to properly inspect the shopping carts and failing to warn of the defective carts.
An unspecified amount is sought for medical expenses and pain and suffering. The plaintiff claims her damages do not exceed $75,000.
Myers is represented by Thomas E. Campbell of Metairie-based Campbell & Campbell Attorneys at Law.
This case has been assigned to Division D Judge Lloyd J. Medley.
