Racetrac Customer sues after being struck by a malfunctioning door

NEW ORLEANS – A Jefferson Parish man is suing a local gas station claiming he was injured after being struck by a malfunctioning door as he attempted to enter the establishment.

Dennis Farve filed a lawsuit against Racetrac Petroleum Inc. and Broadspire Services in the Orleans Parish Central District Court on Mar. 11. Farve claims that as he went to enter a Ractrac Petroleum gas station in St. Tammany Parish he was struck by the gas station door. The plaintiff alleges he suffered severe injuries to his lumbar and cervical spine, ribs, knees and is subsequently suffering from headaches due to the incident.

The defendant is accused of creating a dangerous condition, failing to correct a danger, failing to inspect the premises, failing to warn of the dangerous condition, failing to provide a premises free from vice and defect and failing to maintain its premises in a hazard free condition.

The suit does not specify the amount plaintiff is seeking for medical expenses and physical pain and suffering.

Stephen F. Armbruster of Scheuermann and Jones will represent Farve in court.

This case has been assigned to Division C Judge Sidney H. Cates IV.
