NEW ORLEANS - A St. James Parish resident has filed a lawsuit claiming he suffered injuries when he tripped and fell while exiting a modular building used as a cafeteria.
Travalas Charles filed suit against Modular Space Corp. on May 9, 2013 in St. Charles Parish District Court. The defendant removed the case to federal court in New Orleans on June 21.
Charles claims he was injured on May 10, 2012 when he tripped and fell as he attempted to traverse the steps attached to the defendant’s cafeteria. According to the lawsuit, the cafeteria steps gave way and collapsed as Charles was exiting the cafeteria. He suffered injuries to his right hip and lower back.
The defendant is accused of negligence for failing to properly and adequately maintain the stairs in a reasonably safe condition, failing to make certain that the area of ingress and egress attached to the cafeteria was maintained such that the steps and platform were properly secured and attached to the cafeteria and for failing to warn persons of the hazards and/or defects on the premises.
The plaintiff is seeking an award of damages for pain and suffering, shock and mental anguish, medical expenses, loss of wages, loss of earning capacity, loss of physical function, loss of enjoyment of life, interest, and court costs.
