NEW ORLEANS—A New Orleans construction company is suing another company after being provided with low-quality concrete mix.
CBD Construction Services LLC filed suit against Baker Ready Mix, LLC in the Orleans Parish Civil District Court on Aug. 14.
The plaintiff claims that in construction of the Huey P. Long Bridge Administration Complex and Maintenance Building, the defendant failed to provide the proper concrete mix as outlined in their contractual agreement.
The defendant is accused of breach contract for supplying CBD Construction with substandard concrete mix that did not meet the required strength of 3,000 pounds per square inch. CBD alleges that Baker’s refusal to pay damages constitutes a breach of the obligation of good faith performance under the contract and that Baker is in violation of the Louisiana Unfair Trade Practices Act for causing “severe financial harm” to CBD with its “unethical, oppressive, and unscrupulous” business practices.
CBD asks that Baker be held liable for costs incurred by CBD for the removal and replacement of the low-quality concrete, which they claim amounts to approximately $75,000 for the removal of the concrete and $150,000 for repaving including labor, supervision, overhead, testing and attorneys’ costs and fees.
The plaintiff is represented by Stephen H. Kupperman of New Orleans-based Barrasso, Kupperman, Freeman & Sarver LLC.
The case has been assigned to Division G Judge Robin M. Giarrusso.
