Suit claims seller failed to disclose heavy liens

NEW ORLEANS – A New Orleans ministry group is suing a company for attempting to sell them a property without disclosing heavy liens placed on it.

Norwood Thompson Ministries filed suit against Interurban Housing Corporation in the Orleans Parish Civil District Court.

The plaintiff claims that it entered into an agreement to purchase property on Hickory Street in New Orleans. The agreement allegedly called for a $10,000 cash deposit plus $5,000 under bond for a total of $15,000. The buyer and seller also allegedly agreed to pay equal amounts on outstanding property liens amounting to $1,840.22. However, the plaintiff claims, the defendant failed to disclose additional liens on the property totaling $11,401.55, which the plaintiff claims it was asked to pay at closing.

The Interurban Housing Corporation is accused of failing to disclose the additional liens and failing to return the $10,000 cash deposit made by the Norwood Thompson Ministries when the agreement was dissolved.

An undisclosed amount in damages sought for negligence and unjust enrichment at the cost of injuring the plaintiff, who lost its deposit and the bargain price of the property. The plaintiff asks for damages with interest, court costs and any other relief.

The plaintiff is represented by attorney Harry E. Cantrell Jr. of New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
