NEW ORLEANS – A woman has filed suit against Starbucks on Magazine Street where she claims faulty packaging led to injury to her foot.

Nicole Drupiewski filed suit against Starbucks Corporation in the Orleans Parish Civil District Court.

The plaintiff claims that she was injured when the bottom of a display box she was lifting collapsed, allowing a coffee mug inside to land on her foot.

The defendant is accused of negligence in the assembly and inspection of the box, failure to discover its improper assembly, allowing packaging insufficiently strong to hold its contents, failing to know and correct the dangerous condition, failing to practice reasonable care in foreseeing or discovering the condition, neglecting to correct the condition, and failing to warn the public of the dangerous condition.

An undisclosed amount in general and special damages is sought for loss of wages, loss of earning capacity, medical expenses and costs of the proceedings.

The plaintiff is represented by George R. Blue Jr. of New Orleans-based George R. Blue Jr. LLC.

The case has been assigned to Division M Judge Paulette R. Irons.

Case no. 2013-08289.
