NEW ORLEANS – A woman is suing the city in connection with injuries she sustained after allegedly tripping on a type of rug that has a long history of bunching up.
Terry McIntosh filed suit against the city of New Orleans, New Orleans Building Corp., Transportation Center Authority for the City of New Orleans and Companion Property and Casualty Insurance Co. in the Orleans Parish Civil District Court on Aug. 30.
The plaintiff claims she fell when she slipped or tripped on a rug that was uneven, curled up, or bunched up. An employee at Union Passenger Terminal also allegedly informed her that “the types of rugs used at the terminal have a tendency to lie in an uneven manner, curl up, bunch up, and/or otherwise fail to remain flat on the floor, thereby creating a fall or tripping hazard.” She claims her injuries include head trauma and a fractured leg.
Defendants are accused of being liable for negligence in using unsafe rugs known to be hazardous, failing to remove, replace, or remedy the situation, failing to provide an unobstructed walking surface and failing to warn.
An undisclosed amount in damages is sought for pain and suffering, loss of enjoyment of life, permanent impairment, past and future mental pain and suffering, emotional distress, home healthcare cots and medical expenses.

The case has been assigned to Division H Judge Michael G. Bagneris.
