Man sues over failure of home elevator

GRETNA – An elevator company is being sued by a man who claims he was severely injured when an elevator installed in his home failed and fell to the ground floor while he was in it.

Janthan “J.C.” Dorr Sr. filed suit against All American Cargo Elevators LLC and American Safety Indemnity Company in the 24th Judicial District Court on Nov. 4.

Dorr alleges that he loaded groceries into the elevator produced and sold by All American Cargo Elevators at his elevated home and that after taking the elevator to the porch he was unloading the groceries when the elevator fell to the ground. The plaintiff claims the free fall of 12.5 feet resulted in severe and disabling injuries.

The defendant is accused of failing to provide a safe product, failing to properly test the product before putting it on the market, failing to maintain the product before installation at the plaintiff’s residence, failing to have proper and adequate warnings and failing to reasonable and prudent care.

An unspecified amount in damages is sought for pain and suffering, medical expenses, mental anguish and loss of enjoyment of life.

The case has been assigned to Division P Judge Lee V. Faulkner.
