GRETNA – An emergency room patient is suing a local hospital for an alleged misdiagnosis.
Gayle Peake filed suit against Jefferson Parish Hospital District No. 1, West Jefferson Medical Center and Kundan Gupta M.D. in the 24th Judicial District Court on Nov. 12.
Peake claims she was admitted to the emergency room at West Jefferson Medical Center on Jan. 19, 2011 complaining of chest pain and shortness of breath. The plaintiff alleges that a heart attack was ruled out after a scan was completed. Peake asserts that doctors continued to give her oxygen and never ascertained the nature of her condition. On Jan. 28, 2011 the plaintiff claims she was again hospitalized and this time she was found to have a pulmonary embolism and deep vein thrombosis for which she underwent surgery and continues to suffer lung and other injuries.
The defendant is accused of failing to assess and reassess the patient, failing to accurately document patient findings and report them and failing to develop and implement adequate deep vein thrombosis protocols.
An unspecified amount in damages is sought for physical pain and suffering, emotional pain and suffering, disfigurement, loss of enjoyment of life, medical expenses, loss of earnings and loss of earning capacity.

The case has been assigned to Division B Judge Cornelius E. Regan.
