Company sues contractor for alleged nonpayment in Habit for Humanity build

NEW ORLEANS – A company is seeking more than $50,000 from a contractor for payment on work  it completed.

Travers Enterprises LLC filed suit against C.D.W. Services LLC and Suretec Insurance Company in the Orleans Parish Civil District Court.

The plaintiff’s petition for damages saying it is owed payment in connection with the construction of Habit for Humanity on Elysian Fields Avenue in New Orleans. Travers Enterprises was employed by the defendant, a general contractor for the project, to complete the painting of the warehouse ceiling and the exterior of the facility, plasterwork and drywall repair, painting of sheetrock and patching of walls for a total of $57,000.

C. D. W. Services is accused of only paying $32,500 for work completed, demanding addition work, and issuing change of orders that allegedly total $31,230. The plaintiff filed a statement of claim asserting a lien for the $55,730 that it maintains is still owed.

An undisclosed amount in damages is sought for the unpaid contract price, for the value of the change of orders, court costs, and attorney fees.

The plaintiff is represented by Kenneth Randall Evans of Evans & Clesi PLC.

The case has been assigned to Division H Judge Michael G. Bagneris.
