Owner of Sonic Drive-In Restaurants sued by repair company

GRETNA – A repair company is suing the owner of numerous fast food restaurants for allegedly not paying for repairs provided to the restaurants.

Lopez Mechanical Inc. filed suit against Kergan Bros. Inc. in the 24th Judicial District Court on Nov. 18.

Lopez Mechanical Inc. claims that Kergan Bros. Inc. owns 54 Sonic Drive-In Restaurants where it regularly performed repairs. The plaintiff asserts that the defendant’s regional manager scheduled work through the restaurant's Jefferson Parish facility that amounted to $45,494.51. Lopez Mechanical Inc. alleges it was asked to withhold invoices until it did not show an impact on the income of the stores and that it agreed to this, but never was paid.

The defendant is accused of breach of contract.

Damages in the amount of $45,494.51 and attorney’s fees are sought by the plaintiff.

Lopez Mechanical Inc. is represented by Covington-based attorney Francis R. White III.

The case has been assigned to Division F Judge Michael P. Mentz.
