Burger King franchise sued for $75K over bathroom injury

NEW ORLEANS – A woman who was allegedly injured by a falling metal frame in the handicapped stall of a Burger King bathroom filed suit against the owners of the franchise.

Cindy Lee filed suit against Strategic Restaurants Acquisition Company LLC and its insurance company in the Orleans Parish Civil District Court.

The suit states that on Nov. 21, 2012, the plaintiff entered the Burger King on Chef Menteur Highway in New Orleans for the purpose of ordering a sandwich. She first entered the handicapped toilet and while exiting the stall, the metal framing around the door allegedly fell off, allegedly striking her head, face, shoulder and body.

The defendant is accused of failing to repair the handicapped toilet and bathroom and the metal frame, failing to warn, failing to place an “out of order” sign and being otherwise negligent.

As a result of the accident, the plaintiff has suffered numerous contusions of the face, head, body, acute cervical and lumbosacral strain, aggravation of lumbar disc disease and possible herniated cervical disk.

She seeks $75,000 in damages for medical expenses, lost wages, pain and suffering, emotional stress, permanent residual disability and loss of earning capacity.

The plaintiff is represented by attorney Darleen M. Jacobs of New Orleans.

The case has been assigned to Division H Judge Michael G. Bagneris.
