Man allegedly pinned between truck and loading dock sues

GRETNA – A man who claims he was injured after being pinned against a loading dock by a truck is suing.

Lawrence E. Williams filed suit against Carl J. Arcenaux Jr., Ronnie Savoy Enterprises Inc. and Progressive Paloverde Insurance Company in the 24th Judicial District Court on Nov. 20.

Williams alleges that he was standing near a loading dock located at Crofton Road in Kenner waiting to hand paperwork to an employee of Statewide Transport when a truck driven by Arcenaux and owned by Ronnie Savoy Enterprises Inc. backed up into him and pinned him between the truck and the concrete loading dock. The plaintiff claims he received severe and permanent bodily injuries in the incident including a ruptured bowel that required emergency surgery.

The defendant is accused of failing to see what should have been seen, failing to keep a proper lookout, recklessness, inattention, improper backing of a truck, failing to use reasonable care and caution approaching a loading dock, carelessness, recklessness and failing to exercise due care and caution.

An unspecified amount in damages is sought for medicine, drugs, hospitalization, medical care, lost wages, loss of wage earning capacity, pain and suffering, residual disabilities, mental anguish, emotional upset, distress, loss of enjoyment of life and rehabilitation and support care.

Williams is represented by Benjamin J. Birdsall Jr. of New Orleans-based Birdsall Law Firm Inc.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
