NEW ORLEANS – A woman who allegedly slipped on pork blood in the meat aisle of a corporate grocery store has filed suit.
Mary Pitts filed suit against Winn-Dixie Montgomery LLC in the Orleans Parish Civil District Court on Oct. 18.
The suit states that on Oct. 22, 2012, the plaintiff was shopping with her son at the Winn-Dixie on Tchoupitoulas Street in New Orleans. When she was in the back of the store looking at meat, she slipped—but then caught herself—on what she later learned was pork blood on the floor, according to the suit. She was able to break her fall before striking the ground, but nevertheless sustained injuries to her right leg and right knee, the suit claims.
Winn-Dixie is accused of failing to clean up blood on the floor, failing to properly wrap meat so that blood did not leak out, failing to have a regular inspection of its floors and failing to have mats down so that any spills could be picked up.
The plaintiff seeks an unspecified amount in damages for physical pain, mental anguish, medical expenses, lost wages and loss of enjoyment of life. The amount does not exceed that necessary for a trial by jury.
The plaintiff is represented by attorney Harry E. Forst of New Orleans.
The case has been assigned to Division J Judge Paula A. Brown.
