Hotel sued by man who slipped and fell on sidewalk in rain

GRETNA – A local hotel is being sued by a man who claims he was injured when he slipped and fell at one of its entrances while it was raining.

Michael B. Russ filed suit against National Union Fire Insurance Company of Pittsburgh PA, EH Hospitality Holdings LLC, Extended Stay America and Loreal Porter in the 24th Judicial District Court on Nov. 27.

Russ claims he was at the Extended Stay America located at 2300 Veterans Blvd. in Metairie and walking up a handicap entrance while it was raining when he slipped and fell on the sidewalk. The plaintiff alleges that the entrance was not illuminated and it was nighttime, both factors of which contributed to his fall. Russ asserts he received severe and disabling injuries in the incident including a fractured knee cap that has required surgery and extensive treatment.

The defendant is accused of creating and allowing a hazardous and unreasonably dangerous condition, failing to warn plaintiff of an unreasonably dangerous condition and failing to install or maintain adequate handicap ramp surfacing, lighting and handrail.

An unspecified amount in damages is sought for pain and suffering, emotional distress, inconvenience and mental anguish.

Russ is represented by attorney James B. Guest of Kenner.

The case has been assigned to Division B Judge Cornelius E. Regan.
