Winn-Dixie sued by customer who slipped and fell in dairy aisle

GRETNA – A grocery store chain is being sued by a customer who claims she was seriously injured in a slip and fall in the dairy aisle.

Danielle Major filed suit against Winn-Dixie Montogomery LLC, Winn-Dixie Louisiana Inc. and Winn-Dixie Stores Inc. in the 24th Judicial District Court on Dec. 17.

Major asserts that she was shopping at the Winn-Dixie at 5901 Airline Drive in Metairie when she was walking down the dairy aisle and she suddenly slipped and fell. The plaintiff alleges that she filed an accident report with Winn-Dixie and an employee took a photo of the scene, including of the spill that caused the fall.

The defendant is accused of failing to see what should have been seen, causing an unreasonably dangerous condition, failing to correct an unreasonably dangerous condition, failing to maintain a safe business environment and failing to warn patrons of an unreasonably dangerous condition.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental anguish, emotional distress, medical expenses, loss of enjoyment of life and loss of pursuit of happiness.

Major is represented by Pius A. Obioha of New Orleans-based Law Offices of Pius A. Obioha and Associates LLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
