Woman who fell while trying to avoid car that was backing up sues

GRETNA – A woman who claims she fell over a curb while trying to avoid a car that was backing into her path in a parking garage is suing the owners of the property.

Delia Leonida filed suit against Edenborn Partners Limited Partnership and United Fire and Indemnity Company in the 24th Judicial District Court on Jan. 30.

Leonida claims she was in the parking lot of the Metairie Center at 2424 Edenborn Ave. in Metairie when a car began to back into her path. The plaintiff alleges that as she was trying to avoid being struck by the vehicle she tripped over a cement stop and fell to the ground. Leonida asserts she received disabling injuries in the incident.

The defendant is accused of failing to provide safe surroundings, failing to maintain the parking lot and cement parking stops, failing to inspect the parking lot, failing to repair defects, failing to properly place parking stops, failing to exercise due care and caution, allowing a dangerous condition to exist and failing to provide a sidewalk.

An unspecified amount in damages is sought for several bodily injuries, medical expenses, lost wages, loss of wage earning capacity, pain and suffering, residual disabilities, mental anguish and emotional upset and distress.

Leonida is represented by attorney Jay M. Napolitano of Metairie.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
