GRETNA – A bankrupt company and its trustee are suing a local company for debts they are allegedly owed from companies controlled by the owner’s son.

Carlone Enterprises LLC and Jan M. Hayden, Chapter 11 Trustee filed suit against Karle A. Carlone, Mardi Gras Party Beads LLC, China Bead Man LLC and Accent Annex Properties LLC in the 24th Judicial District Court on Jan. 31.

On Feb. 1, 2012 Carlone Enterprises, owner and operator of the Accent Annex Mardi Gras accessory store located at 100 N. Labarre Road in Metairie, entered into voluntary Chapter 11 bankruptcy at which time Hayden was named the business’s trustee. The plaintiff asserts that the store property along with two warehouses and another store they leased out to Mardi Gras Party Beads LLC and were sold as part of the bankruptcy proceedings. Carlone Enterprises and Hayden claims that on Sept. 25, 2006 Karl Carlone along with the other defendants entered into commercial leases for three properties owned by Carlone Enterprises that required them to pay monthly rents of $16,666, $13,750 and $10,000 as well as two percent of all sales profit.

Carlone Enterprises alleges that the leases were automatically renewed for the following four years and were not paid in a timely manner despite repeated requests.

The defendant is accused of breach of contract.

The plaintiffs request that the defendant made to be paid all amounts due under the lease contract.

The plaintiffs are represented by Kyle Schonekas of New Orleans-based Schonekas, Evans, McGoey & McEachin LLC.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
