Construction company sues homeowners for $30K after home elevation

GRETNA – A local construction company is suing a pair of homeowners for allegedly not paying off a promissory note.

Robert Wolfe Construction Inc. filed suit against Eric and Glynis Bailey in the 24th Judicial District Court on Feb. 11.

Robert Wolfe Construction Inc. alleges the Baileys signed a promissory note in the amount of $30,000 which was part of $130,000 contract to lift their home. The plaintiffs claim that since first signing the promissory note on Jan. 31, 2011 the defendants’ home was raised, but the $30,000 has not be paid to them. Robert Wolfe Construction Inc. asserts that the work they provided was done under the State of Louisiana Home Hazard Mitigation Program.

The defendant is accused of breach of contract, detrimental reliance and unjust enrichment.

Damages in the amount of $30,000 plus attorney’s fees and legal costs are sought by the plaintiff.

Robert Wolfe Construction Inc. is represented by Lauren E. Checki of New Orleans-based Varadi, Hair & Checki LLC.

The case has been assigned to Division I Judge Nancy A. Miller.
