Homeowner whose home allegedly caught fire suing over insurance claim

Breach of contract

GRETNA – A homeowner is suing over an insurance claim she alleges has not been fully paid.

Marie Taylor filed suit against Colony Insurance Company and Cypress Park II Homeowner Association Inc. in the 24th Judicial District Court on March 13.

Taylor asserts she is the owner of a property located at 2846 Steamship Circle in River Ridge that is within the Cypress Park II Homeowner Association. The plaintiff alleges that a fire broke out on the property last March and sustained serious water, fire and smoke damage. Taylor claims as a result the property had to undergo major renovations.

The plaintiff asserts the insurance claim was not timely reported by the Cypress Park II Homeowner Association which carried the policy and which was provided initial payment for the damages by the Colony Insurance Company in July 2013. The plaintiff also states that additional depreciation funds were not to be provided until the repairs were completed.

Taylor claims the repairs still have not been completed due to the claim report being delayed and that she should receive the depreciation claims payment she is due.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for compensation and attorney’s fees.

Taylor is represented by M. Elizabeth Bowman of Gretna-based Bowman & Howley.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
