GRETNA – A roofer is suing a local property owner for injuries he allegedly received in a fall off a ladder that broke while he was climbing it.
Joseph Adams, and wife Tammy Contanchis Adams, filed suit against Gayle K. Duclaux in the 24th Judicial District Court on March 13.
Adams asserts he was in the scope of his employment as a roofer for Tandem Roofing LLC at Duclaux’s residence located at 239 West Livingston Place in Metairie when he was instructed to climb up a ladder that had already been set up to access the roof. The plaintiff claims as he began to climb the ladder it broke and he fell to the ground. Adams alleges he received severe and disabling injuries in the fall.
The defendant is accused of instructing the plaintiff to use a faulty ladder, failing to provide a safe means to access the roof, failing to exercise reasonable care, failing to warn of potential hazards, failing to maintain the ladder in a safe manner and failing to maintain control of the ladder.
An unspecified amount in damages is sought for medical expenses, loss of wages, lost earning capacity, physical pain and suffering and mental anguish.
Adams is represented by attorney Julien F. Jurgens of Metairie.
The case has been assigned to Division P Judge Lee V. Faulkner Jr.
Case no. 736-469.
