Wal-Mart sued by woman claiming injury after falling in hole

GRETNA – A retail giant is being sued by a woman who claims she was seriously injured after stepping in a hole on the premises.

Monique Lation filed suit against Walmart Limited Partnership, Martin Family Private Holdings LP and their insurer in the 24th Judicial District Court on March 18.

Lation asserts that on Aug. 3, 2013 she was shopping at the Wal-Mart located at 1501 Manhattan Blvd. in Harvey when she stepped into a hole. The plaintiff alleges she received severe and disabling injuries to her left knee and ankle in the incident.

The defendant is accused of allowing a hazard to exist on the premises, failing to warn patrons of dangerous condition, allowing a hole to remain uncovered and failing to maintain the property so as to render it safe for patrons.

An unspecified amount in damages is sought for lost wages, impaired earning capacity, mental anguish, medical expenses, physical pain and suffering, mental pain and suffering and permanent disabilities.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
