GRETNA – A local lumber company is being sued by a homeowner who claims his home was infested by beetles that were in flooring materials installed by the company.
Girven A. Mullen filed suit against Lumber Liquidators Inc. and their insurer in the 24th Judicial District Court on March 21.
Mullen claims that on his behalf his son ordered from Lumber Liquidators flooring materials for his home located at 333 N. Rio Vista Ave. in Jefferson. The plaintiff asserts that the defendant delivered and installed the flooring ordered by his son and that shortly afterward he noticed a strange looking insect. Mullen alleges a fumigation company that was called to his residence identified the bug as a beetle which had infested the home and would cost $3,200 for a tent fumigation to eradicate. Due to the fumigation company’s finding the defendant claims that he had the home fumigated over a three day period.
An unspecified amount in damages are sought for emotional upset and distress, cost of fumigation, cost of labor and materials to replace damaged flooring and diminished value of the home.
Mullen is represented by G. Patrick Hand of The Hand Law Firm APLC of Gretna.
The case has been assigned to Division I Judge Nancy A. Miller.
Case no. 736-765.
