Apartment building owners sued over alleged mold exposure

Courtyard 91 448x336

GRETNA – Tenants at a local apartment building are suing after they experienced health problems due to long-term mold exposure.

Akeidra Massey and Joseph Jacks filed suit against Willwoods Community, Willwoods Community Management Inc. and their insurer in the 24th Judicial District Court on March 26.

Massey and Jacks assert they were tenants at the Courtyard Apartments located at 1620 Carol Sue Ave. in Gretna. The plaintiffs allege that on March 28, 2013 they were diagnosed with being exposed to high levels of mold content in the building. Massey and Jacks claim they sustained serious injuries due to the exposure.

In addition, the plaintiffs assert they had made the owners of the premises aware that the apartment had suffered water intrusion during Hurricane Isaac that were not remedied prior to experiencing health effects from the mold.

The defendant is accused of failing to maintain the premises in a reasonable and safe condition, failing to correct an inherently dangerous condition, allowing the premises to remain in a condition of disrepair, allowing an unsafe condition to exist and violating a duty to the plaintiff.

An unspecified amount in damages is sought for pain, suffering, disability and economic loss.

Massey and Jacks are represented by attorney J. Nelson Mauyer III of New Orleans.

The case has been assigned to Division L Judge Donald A. Rowan Jr.

Case no. 736-836.
