GRETNA – A company that leased a truck that caught fire is suing the leasing company.
Stericycle Inc. filed suit against Idealease Services Inc. of Illinois and Navistar Financial Corporation in the 24th Judicial District Court on May 16.
Stericycle Inc. alleges it entered into an agreement to lease trucks to Idealease Services Inc. of Illinois beginning on Nov. 6, 1996. The plaintiff asserts that as part of the lease the defendant agreed to provide maintenance and repairs for all of the vehicles. Stericycle Inc. claims that a vehicle it leased caught fire and the vehicle was a total loss.
The plaintiff claims that because the vehicle was needed for daily business it paid $13,793.02 for the remainder of the lease in an effort to expedite a replacement vehicle. Stericycle alleges it found the fire was due to a short in the wiring and poor maintenance. Subsequently, the plaintiff asked for the return of the lease buyout, which it has not received, the suit claims.
The defendant is accused of breach of contract, failing to safeguard the truck, failing to perform required maintenance, failing to train employees and allowing the truck to catch fire.
An unspecified amount in damages is sought for the $13,793.02 payment, loss of business during the time the truck was out of use, loss of use when the truck was inoperable, storage costs, expenses to lease a new truck and attorney’s fees.
