Man claims restaurant served alcohol to minors who struck him in head with bottles

GRETNA – A Gretna restaurant is being sued by a man who claims he received a brain injury after being bludgeoned with  liquor bottles wielded by under age patrons who had been served alcohol on the premises.

Argenis Ramirez filed suit against Seneca Insurance Company, Chilito’s Seafood & Oyster Bar Inc., Roseysis Ortega, Viktor Santiago and Francisco Ortega in the 24th Judicial District Court on May 19.

Ramirez alleges he was at Chilito’s Seafood & Oyster Bar located at 1801 Stumpf Blvd. in Gretna in a crowd of around 100 people listening to music. The plaintiff asserts that after he approached a disc jockey and requested a song to a table he was sharing with his friends he was confronted by Ortega. Ramirez claims without provocation he was struck in the head by Ortega with a liquor bottle and fell to the ground. Rameriez alleges that as he lay on the ground Santiago hit him in the head with a beer bottle.

The plaintiff asserts that the attack resulted in a laceration on his head as well as bleeding under his skull and on his brain.

The restaurant is accused of failing to provide adequate security on its premises, serving alcohol to persons under the age of 21, creating a hazardous condition and allowing an excessive number of patrons on its premises.

An unspecified amount in damages is sought for permanent bodily injury, medical expenses, pain and suffering, loss of income, loss of earning capacity, mental anguish and emotional distress.

Ramirez is represented by J. Wayne Mumphrey of Slidell-based Mumphrey Law Firm LLC.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
