GRETNA – A local real estate rental company is being sued by one of its tenants who claims she was severely injured after tripping over a wall while walking her dog.
Darlene Mince filed suit against Victoria Witte, wife of Terry Laurent, and Theodore A. Kraft Jr. Realty LLC in the 24th Judicial District Court on May 19.
On May 6, 2013, Mince claims that she was living in a rental unit located at 521 Lake Ave. in Metairie, owned and operated by Witte and Laurent, when she went out to walk her dog. The plaintiff alleges that as she progressed along the property she tripped over a concrete border and fell to the ground and was knocked unconscious. Mince asserts that she sustained several injuries in the incident including a broken collarbone.
The defendant is accused of failing to do what should have been done, failing to keep a clear pathway at all times, disregarding the safety of others, failing to keep a clear pathway, disregarding the safety of others, failing to notice the imminence of an accident, creating a trap, improper and inadequate maintenance of the premises, maintaining a defective premises and failing to warn of the defective nature of the premises.
An unspecified amount in damages is sought for pain and suffering, medical expenses and loss of enjoyment of life.

The case has been assigned to Division F Judge Michael P. Mentz.
