NEW ORLEANS – A woman who claims to have slipped at a Walgreens location while completing an ATM transaction is suing the corporation and its insurance provider.
Willmarine Hurst filed suit against Walgreens and its insurer in the Orleans Parish Civil District Court on May 20.
Hurst claims that on May 24, 2013 she entered the drugstore located at 1100 Elysian Fields Avenue in New Orleans. The plaintiff asserts that after completing her intended ATM transaction, she slipped and landed on a sign that had fallen. Hurst contends that the sign had been down from the time that she entered the store and remained there throughout her transaction.
According to the suit, a Walgreen’s employee is reported to have been present to witness the incident and the sign’s condition. Hurst maintains that she sustained serious bodily injury as a result of the fall.
The defendant is accused of failing to observe the sign, failing to maintain proper condition of their premises and failing to correct a hazardous condition in a timely manner.
The plaintiff is seeking an unknown amount in damages for pain and suffering.
