Forensics firm sues law firms over alleged failure to pay expert witness fees

GRETNA – A company that provides expert witnesses is suing a local law firm for allegedly not paying for services.

U.S. Forensic LLC filed suit against Anzelmo, Milliner & Burke LLC in the 24th Judicial District Court on June 30.

U.S. Forensic LLC alleges that it contracted with Thomas Milliner and Anzelmo, Milliner & Burke to provide an expert witness for the amount of $11,173.50 that was due by Dec. 21, 2013. The plaintiff asserts that after a deposit and partial payment the total amount owed decreased to $4,813.50 when the defendant notified the plaintiff they would no longer need their services on the case as it had settled.

U.S. Forensic LLC contends that a check issued by Anzelmo, Milliner & Burke had a stop placement put on it, making it not able to be cashed. The plaintiff claims Milliner later stated that the payment had been rescinded due to inconsistencies with the expert’s deposition, testimony and background that made the firm believe the amount was not due.

The defendant is accused of breach of contract and unjust enrichment.

Damages in the amount of $4,813.50 is sought by the plaintiff.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
