Health club and spa sued over alleged sauna slip and fall

COVINGTON – A man is suing a Covington health club and spa after allegedly falling while exiting the sauna.

John S. Sutton filed suit against Stone Creek Club and Spa LLC in the 22nd Judicial District Court on July 23.

The plaintiff claims that as he was exiting the spa’s sauna a step shifted, causing his foot to slip and his head to hit the corner of the sauna bench. According to the suit, the “crudely-fashioned” steps lacked any sort of non-skid material to keep them from slipping on the ceramic tile, and were not fastened to the floor, wall, or benches to prevent them from moving.

The defendant is accused of negligently failing to properly construct the sauna bench, failing to apply non-skid surface to the steps while knowing that the sauna would be subjected to high humidity and moisture, failing to secure steps, failing to provide a railing and maintaining dangerous and defective conditions on its premises.

An unspecified amount in damages is sought by the plaintiff for various and severe injuries, past, present, and future pain and suffering, mental anguish, anxiety, emotional distress, loss of enjoyment of life, limitations of activities, medical expenses and loss of wages.

The plaintiff is represented by Michael B. Alker and Charles E. Sutton of Mandeville-based Sutton, Alker and Rather LLC.

The case has been assigned to Division J Judge William Knight.
