Ruth's Chris Steakhouse sued over patron's injury

NEW ORLEANS – A woman is suing Ruth's Chris Steakhouse's parent corporation, its insurers, and a construction company for their alleged role in her injury.

Gehon Montgomery filed suit against Beloumagner Construction Company, American Zurich Insurance Company and Ruth's Hospitality Group in the Orleans Parish Civil District Court on June 25.

Montgomery claims that on Sept. 14, 2013 she was being seated at Ruth's Chris Steakhouse on 525 Fulton Street in New Orleans. As she was being led to the sun room, the front of her foot became lodged underneath the sill connecting the main dining room to the sun room area, the suit says.

Montgomery asserts that when her shoe caught under the threshold, she was jerked forward. The plaintiff contends that this caused serious damage to her spine, together with grave and indelible injuries. Montgomery further alleges that she was never warned by the staff employed at Ruth's Chris about the protruding threshold.

The defendant is accused of negligence, including failure to maintain a reasonably safe area for its patrons, failure to provide immediate assistance to the plaintiff, failure to warn its patrons, failure to correct a dangerous condition and reckless endangerment.

The plaintiff seeks an unknown amount in damages for physical disability, physical and mental pain and suffering and medical expenses.

The case has been assigned to District H Pro Tempore Judge Lynn Luker.
