GRETNA – A couple who own a home that was allegedly damaged in Hurricane Isaac in 2012 is suing their property insurer.
Joni S. and Gregmann Bryant filed suit against QBE First Insurance Agency Inc. and QBE Specialty Insurance Company in the 24th Judicial District Court on July 8.
The Bryants assert that when Hurricane Isaac struck south Louisiana on Aug. 26, 2012 their home suffered severe roof damage, water damage, damage to the home’s exterior and other various covered areas. The plaintiffs claim the defendant failed to properly adjust their claim and did not properly cite the cause and extent of damage to the home. The Bryants contend that QBE adjusters ignored much of the damage to the home and only confirmed damages up to $23,000 when the damage costs were actually much higher.
The plaintiffs allege that due to the defendants’ actions their property has not been able to be repaired.
The defendant is accused of breach of contract, bad faith claims handling, negligent claims handling, non-prompt payment, negligent misrepresentation and violation of state law.
Damages in excess of $50,000 are sought for diminution in the value of property, repair and remediation expenses, amount due not previously paid, cost to hire investigative and engineering firms, mental anguish, loss of use, attorney’s fees, prejudgment interest and litigation costs.

The case has been assigned to Division I Judge Nancy A. Miller.
