Construction company sues City of New Orleans over bid review process

NEW ORLEANS – A construction company has filed suit against the City of New Orleans over its bid contract process claiming the city has wrongly retracted a contract.

Boh Bros. Construction Co. LLC filed suit against the City of New Orleans in the Orleans Parish Civil District Court on July 9.

The plaintiff claims it properly filed a bid for a project to the defendant, and was the lowest responsive bidder. Boh Bros. Construction Co. alleges the defendant acknowledged it was the lowest responsive bidder at one time, but has since retracted the plaintiff’s bid. The plaintiff claims the defendant’s refusal to award the contract is in violation of the public bid laws of the State of Louisiana because it filed a correct bid that was the lowest price. Boh Bros. Construction Co. claims the defendant intends to award the contract to a different company and has asked the court for an injunction to prevent such an occurrence.

The plaintiff is seeking an injunction that demands the City of New Orleans to award the contract to the plaintiff, or in the alternative the plaintiff is seeking an unknown amount in damages for loss profits, bid preparation costs, and attorney’s fees.

The case has been assigned to Division H Pro Tempore Judge Lynn Luker.
