After car allegedly damaged in car wash, man sues gas station claiming personal injury

GRETNA – A gas station is being sued by man who claims he was injured and his car was damaged when he ran into an open drain in their car wash.

Raymond S. Dave Jr. filed suit against an unknown owner, Brother’s Convenience Store and their insurer in the 24th Judicial District Court on July 15.

Dave asserts that he was at the Brother’s Convenience Store located at 123 Terry Parkway in Gretna and used the drive through car wash at the location when his vehicle suddenly fell into a drain. The plaintiff alleges that upon closer inspection the drain grates had been removed. Dave contends the incident resulted in him receiving injuries necessitating medical attention.

The defendant is accused of leaving the car wash in a defective state.

An unspecified amount in damages is sought for pain and suffering, mental anguish, loss of wages, reimbursement for medical expenses, damage to vehicle, loss of use of vehicle and reimbursement for towing.

Dave is representing himself pro se in the incident.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
