Leaking Coca-Cola vending machine allegedly results in woman’s injuries

GRETNA –Coca-Cola Refreshments USA Inc. is being sued by a woman who claims she was injured after slipping and falling in a puddle caused by a malfunctioning vending machine.

Shikita Harper filed suit against Coca-Cola and Rouse’s Enterprises Inc. in the 24th Judicial District Court on July 23.

Harper alleges she was on the premises of Rouse’s Market at 100 W. Esplanade Ave. in Kenner when she stepped in a puddle of water and fell to the ground. The plaintiff claims the puddle was created by a vending machine situated nearby. Harper asserts she received injuries to her left side, neck, back, hip, knee, ankle and thumb.

The defendant is accused of failing to keep the vending machine in a reasonably safe condition, failing to prevent harm from being suffered n the property, failing to warn of the dangerous condition, failing to use reasonable care, failing to warn of the property’s unreasonable risks, failing to properly inspect and remove hazards and failing to provide hazard-free environment.

An unspecified amount in damages is sought for pain and suffering, medical expenses, future possible surgeries, loss of enjoyment of life, loss of consortium, lost wages, mental anguish, lost wages, property damage and disability.

Harper is represented by Charles M. Thomas of Huber, Slack, Thomas and Marcelle LLP.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
