Winn Dixie sued by customer who was allegedly injured in fall

GRETNA – A corporate grocery store is being sued by a customer who claims she was injured in a fall after slipping in a clear substance.

Michelle Gardner filed suit against Winn Dixie Montgomery LLC, Bi Lo LLC, John Doe and their insurer in the 24th Judicial District Court on July 24.

Gardner contends she was a customer at the Winn Dixie located at 5902 Airline Drive in Metairie on Aug. 1, 2013 when she slipped on a clear liquid in the spice aisle and fell to the floor.

The defendant is accused of creating a dangerous condition, failing to have in effect an adequate floor inspection, creating and maintaining an unreasonable condition, failing to maintain the premises in a safe condition, permitting an unsafe condition, failing to warn visitors, failing to promulgate proper safety rules and failing to use reasonable care.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, mental anguish, disability, permanent scarring, disfigurement, medical expenses, rehabilitation expenses and loss of enjoyment of life.

Gardner is represented by Kris P. Kiefer of Metairie-based Kiefer & Kiefer.

The case has been assigned to Division J Judge Stephen C. Grefer.
