Patient sues Ochsner claiming injuries from a fall

GRETNA – A local hospital is being sued by a patient who claims she was injured in a trip and fall on its premises.

Tamara Martino filed suit against Ochsner Medical Center Kenner LLC, Ochsner Health System, Ochsner Clinic Foundation, Ochsner Hospital of Kenner and their insurer in the 24th Judicial District Court on Aug. 1.

Martino alleges that on Aug. 6, 2013 she was walking on the sidewalk in the lobby of the Ochsner Medical Center in Kenner when she was called by a nurse. After she got out of her chair and walked toward the nurse she tripped on a liner protruding from the floor. The plaintiff asserts she received severe injuries, including a broken femur, in the incident.

The defendant is accused of failing to ensure the premises was safe, failing to provide notice of an unsafe area, failing to warn in any manner of the hazardous and dangerous area, failing to inspect the premises and failing to provide a safe place for visitors.

An unspecified amount in damages is sought for medical expenses, surgery expense, loss of wages and loss of earning capacity.

Martino is represented by Anthony S. Taormina of Metairie-based Law Offices of Anthony Taormina.

The case has been assigned to Division J Judge Stephen C. Grefer.
