Motorist sued after allegedly striking car, pushing it into woman’s apartment as she lay in bed

GRETNA – A woman who claims she was injured when a motorist stuck a car in a parking lot and pushed it into her apartment while she was lying in bed is suing.

Esperanza Villegas filed suit against Unique Insurance Company and Carlos Roberto Canales Cruz in the 24th Judicial District Court on Sept. 3.

Villegas alleges she was laying in her bed in her apartment located at 2425 Oxford Place in Gretna on Oct. 12, 2013 when Cruz drove his car at a high rate of speed into another car that struck the wall of her apartment. The plaintiff contends that the impact of the accident pushed the wall into the plaintiff’s bed and dresser. Even though she was able to escape the scene, Villegas asserts that the incident resulted in her re-injuring a preexisting back problem and causing other injuries.

The defendant is accused of failing to maintain proper vigilance, failing to act as a prudent driver, failing to keep a proper lookout, failing to apply brakes properly and carelessly operating his vehicle.

An unspecified amount in damages is sought for medical expenses, mental pain and suffering, physical pain and suffering and loss of enjoyment of life.

Villegas is represented by J. Van Robichaux Jr. of New Orleans-based Robichaux Law Firm LLC.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
