City of Gretna sued by motorist allegedly injured after driving in hole in street

GRETNA – A motorist is suing the City of Gretna after he and a passenger were allegedly injured when they drove into a hole that was obscured by water.

Cornelius Divinity and Qudstella Norman filed suit against the City of Gretna in the 24th Judicial District Court on Sept. 5.

Divinity alleges he was driving along a city street in Gretna on May 9 and Norman was riding in his car as a passenger when they made turn onto Virgil Street and ran into a hole in the roadway that was covered by water. The plaintiffs contend that they received painful and serious personal injuries in the incident.

The defendant is accused of failing to regularly maintain and inspect the streets, failing to timely repair the damaged areas of the streets, failing to warn persons of defective conditions, failing to properly mark off damaged areas of the street and allowing a dangerous condition to exist after proper notice.

An unspecified amount is sought for personal injury, property damage and economic damage.

Divinity and Norman is represented by attorney Pierre F. Gaudin of Gretna.

The case has been assigned to Division F Judge Michael P. Mentz.
