Customer claims toilet paper dispenser injury at Corky’s Ribs & BBQ

GRETNA – A local restaurant is being sued by a customer who claims she was injured when she was sitting on the establishment’s toilet and the toilet paper holder collapsed and fell on her.

Celestine Carter filed suit against Cochon De Lait Ltd., Corky’s Cochon De Lait Ltd., Corky’s Ribs & BBQ, Corchy’s and Mesa Underwriters Specialty Specialty Insurance Company in the 24th Judicial District Court on Sept. 10.

Carter contends she was a customer at Corky’s Ribs & BBQ located at 4243 Veterans Blvd. in Metairie and was sitting on the toilet when she reached up to get some toilet paper and the toilet paper rack fell on her upper body, resulting in her being injured. The plaintiff asserts she sustained injuries to various parts of her body in the incident for which she has had to undergo continued medical treatment.

The defendant is accused of failing to keep their premises in a safe condition, allowing a dangerous condition to be present in the restroom, failing to warn of danger and failing to perform proper inspections.

An unspecified amount in damages is sought for personal injury.

Carter is represented by attorney Robert T. Hughes of New Orleans.

The case has been assigned to Division B Judge Cornelius E. Regan.
