Baymont Inn and Suites files hurricane suit against Louisiana Citizens Property Insurance Corporation

NEW ORLEANS – The corporation that owns Baymont Inn and Suites of New Orleans is suing their insurer for allegedly failing to pay for damages resulting from Hurricane Isaac.

SBT I-10 Service Road and Baymont Inn and Suites New Orleans filed suit against Louisiana Citizens Property Insurance Corporation in the Orleans Parish Civil District Court on Aug. 28.

Baymont claims that Hurricane Isaac caused extensive damage to the hotel's structure on Aug. 28, 2012. The plaintiff says that the total cost of repairs was at least $560,000, and that this amount is covered under their policy with the defendant.

According to the suit, Baymont petitioned the Orleans Parish Civil District Court to appoint an umpire ex parte for the appraisal process in May 2014. Baymont avers that the appraisal process is still ongoing, but due to approaching deadlines, they have chosen to file a petition for damages.

Baymont claims that because of LCPIC's unwillingness to pay for repairs in a timely fashion, the hotel began manifesting interior damage in 2013. This has reportedly rendered the hotel unusable and substantially reduced occupancy and revenue.

The petition states that the hotel continued to incur substantial expenses in association with un-rentable rooms and suffered substantial losses of revenue as a result of hurricane damage.

Baymont asserts that their business losses to date total approximately $1 million and their damages remain uncompensated.

The defendant is accused of breach of contract undisputed documented losses failure to pay.

The plaintiff seeks an unknown amount in damages to cover all repairs pursuant to their claim, together with lost revenue, court costs and attorney’s fees.
