NEW ORLEANS – A couple is suing a statewide insurer for allegedly not paying for damages pursuant to an insurance claim filed after Hurricane Isaac's landfall.
Marlene and Eldefonso Zuniga filed suit against Louisiana Citizens Property Insurance Corporation in the Orleans Parish Civil District Court on Aug. 28.
The Zunigas claim that their property located at 3330-3332 Bienville Street in New Orleans was insured by the Louisiana Citizens Property Insurance Corporation when Hurricane Isaac made landfall on Aug. 28, 2012. According to the suit, the couple's property was significantly destroyed by the storm's winds and water intrusion.
The plaintiffs say that they submitted satisfactory proof of loss to Citizens detailing structural damage, content damage, and business interruption loss, all of which should have been covered under their policy.
The Zunigas assert that Citizens has delayed, denied and refused full payment of their claim.
The defendant is accused of breach of contract and bad faith.
The plaintiffs are seeking an unknown amount in damages for their claim in addition to penalties, attorney's fees and court costs.

The case has been assigned to District N Judge Ethel S. Julien.
