Family sues funeral home for allegedly not honoring life insurance policy purchased in 1963

GRETNA – A local funeral home is being sued by the family of deceased man for allegedly not honoring a life insurance policy he purchased in 1963 to partially pay for his funeral.

The Succession of Christopher G. Giustiniano, Santo Giustiniano (individually and in his official capacity as independent executor), Julian Giustiniano, Buffy Thomas (in her capacity as natural tutrix of a minor child) and Gretchen Ford Giustiniano filed suit against Mothe Life Insurance Company, Mothe Funeral Homes LLC and their insurer in the 24th Judicial District Court on Nov. 14.

The plaintiffs assert that Christopher G. Giustiniano executed a life insurance policy with the defendants in 1963 in which they promised to provide a funeral for him upon his death. The Giustinianos claim that the insurance policy was worth $700 that would go towards the total cost of $4,802.39 for the funeral. However, the plaintiffs allege that the defendants failed to perform the funeral as promised pursuant to the life insurance policy.

The Giustinianos claim the disagreement between them and the defendants caused them emotional harm and tainted the burial and grieving process.

The defendant is accused of violating Louisiana’s Unfair Trade Practices and Consumer Protection Law.

An unspecified amount in damages is sought by the plaintiffs.

The plaintiffs are represented by attorney J. Christopher Ford of Metairie.

The case has been assigned to Division J Judge Stephen C. Grefer.
